THE DOJO – LIABILITY WAIVER, RELEASE & ASSUMPTION OF RISK

1. Acknowledgement of Risks

I understand that participation in martial arts, jiu-jitsu, kickboxing, MMA, grappling, fitness classes, open mat, strength training, conditioning, and all other activities offered by The Dojo involves inherent risks. These risks include, but are not limited to: physical injury, falls, sprains, strains, fractures, concussions, contact with other participants, equipment-related injuries, and other unforeseen events.

I acknowledge that injuries may occur during training, exercises, demonstrations, sparring, or while on the premises, regardless of supervision.

2. Voluntary Participation

I certify that I (or my child) am voluntarily participating in activities at The Dojo and assume full responsibility for any risk of injury, loss, or damage, whether caused by negligence or otherwise.

3. Health & Physical Condition

I confirm that I (or my child) am physically capable of participating safely. I agree to disclose any medical conditions, injuries, allergies, or limitations that may affect participation. I understand The Dojo staff are not medical professionals and will not diagnose or treat any injury or condition.

4. Release of Liability

In consideration for participating at The Dojo, I hereby release, waive, and discharge The Dojo, its owners, instructors, employees, volunteers, and agents from any and all liability, claims, demands, actions, or causes of action arising out of participation in activities, including transportation associated with official programs.

This includes injuries, damages, or losses occurring during or after participation, whether caused by negligence or otherwise.

5. Indemnification

I agree to indemnify and hold harmless The Dojo and its representatives from any claims, damages, or expenses (including legal fees) arising from my or my child’s participation, conduct, or presence on the premises.

6. Personal Belongings

I understand The Dojo is not responsible for lost, stolen, or damaged personal property.

7. Photography & Media Release

I grant permission for The Dojo to use photos or videos of myself or my child for promotional and marketing purposes, unless written notice is provided requesting otherwise.

8. SCHOOL PICKUP PROGRAM – ADDITIONAL TERMS (Lil' Monkeys Program)

If enrolling in the School Pickup Program, I understand and agree to the following additional terms:

1. Transportation & Supervision:
   My child will be walked from the elementary school to The Dojo by authorized staff. Supervision will be provided from the time of school dismissal until the start of their scheduled class.

2. Responsibility During Transition:
   I acknowledge that while staff will take reasonable steps to ensure safety during the walk and supervised period, The Dojo is not liable for incidents that fall outside typical, reasonable supervision, including sudden acts of other students, pedestrians, or environmental hazards.

3. Changes in Schedule:
   I agree to notify The Dojo immediately if:
   – My child will be absent from school
   – My child will not require pickup that day
   – My child is being picked up early or has alternate arrangements
   Failure to communicate may result in missed pickup, for which The Dojo is not responsible.

4. Release for School Property:
   I authorize The Dojo staff to pick up my child from school grounds and assume care after dismissal.

5. Late Pickup:
   Parents are expected to pick up on time after class. Repeated lateness may result in removal from the pickup program.

6. Program Fees:
   I understand the pickup service is an add-on fee charged monthly and must be active for the duration of participation.

9. Acknowledgment & Consent for Minors

If the participant is under 18, I acknowledge that I am the parent or legal guardian and fully accept these terms on their behalf.

10. Agreement

By signing this waiver, I confirm that I have read, understood, and agree to all terms in this waiver. I enter into this agreement voluntarily and intend for it to be legally binding.
